ACCEPTANCE OF TERMS

Your access to and use of www.proauthorsites.com  and any services is subject exclusively to these Terms and Conditions. You will not use the Website/Services for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the Website/Services you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must immediately stop using the Website/Services.

We reserve the right to update or amend these Terms and Conditions at any time and your continued use of the Website/Services following any changes shall be deemed to be your acceptance of such change. It is therefore your responsibility to check the Terms and Conditions regularly for any changes.

GENERAL 

Pro Author Sites reserves the right to suspend or cancel a customer's access to any or all services provided by Pro Author Sites, where Pro Author Sites decides that the account has been inappropriately used. Pro Author Sites reserves the right to refuse service and/or access to its servers to anyone. Pro Author Sites does not allow any of the following content to be stored on its servers:

• Any material which infringes upon copyright, patent, or any other applicable intellectual property laws. The onus is on you the customer to prove that you own the rights to publish material, not for Pro Author Sites to prove that you do not.
• Adult material, including all pornography, erotic images, or otherwise lewd or obscene content.
• Downloadable files that do not form part of the site's content, and are not linked to from within that content.
• Excessive numbers of downloadable files. 

Refusal of service based on content matching any of these criteria is entirely at the discretion of Pro Author Sites. Pro Author Sites reserves the right to move your data to a different server without prior notice.

EMAIL SERVICE PROVISION 

If Pro Author Sites identify a mailbox or domain that is causing problems; we will either remove the offending mailboxes or change their settings to resolve the issue. In extreme cases, we will disable email or suspend all services to the domain as appropriate.You may not use Pro Author Sites email services for any of the following:

• To send messages or communications, which are unsolicited, offensive, abusive, indecent or obscene.
• To send messages causing annoyance, inconvenience or anxiety to another user of the Internet.
• To send messages for the purpose of Fraud and /or with the intention of committing a criminal offence.
• To prevent Pro Author Sites's IP addresses being blacklisted, a domain held on Pro Author Sites servers may be disabled where we have received significant volumes of complaints concerning unsolicited mail originating from or unsolicited email being sent to promote sites being hosted on a Pro Author Sites server.

HIGH RESOURCE USE POLICY 

Pro Author Sites may, at its sole discretion, immediately suspend a site that is found to be using an unreasonable amount of system resources, including processor utilization. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers. Customers may be offered an option whereby Pro Author Sites continues hosting the site for an additional fee.

YOUR PERSONAL DETAILS 

Please note that whilst your email address is primarily used for billing purposes, Pro Author Sites reserves the right to email you information about enhancements to our systems and product offerings. We will not provide any of your personal information to other companies or individuals without your permission. However, we may need to provide your name and delivery address to third parties that Pro Author Sites may use for the purposes of delivering specific services to you (e.g. customer support).

MARKETING AND PROMOTION 

All Pro Author Sites packages require the inclusion of a promotional link for our services within the footer area of customer's sites. This promotional link will be included within the templated site design, and will not require any action on the part of the customer. We also reserve the right to use high level information and links to customer's sites within our marketing materials. Such use will never expose any of your personal details, in line with our published Privacy Policy.

PAYMENT POLICY 

All accounts are set up on a renewing subscription basis. Any client that fails to renew or defaults on payment risks having their website shut down.

CANCELLATION AND REFUNDS 

Pro Author Sites reserves the right to cancel the service at any time. In this event customers will be entitled to a pro rata refund based upon the remaining period of prepayment. If a customer contravenes Pro Author Sites's terms of service a refund will not be issued in the event of a cancellation. Customers may cancel their account at any time by providing 30 days written notice to Pro Author Sites. Fees charged on a prepay basis are non-refundable.

INDEMNIFICATION 

Customer agrees that it shall defend, indemnify, save and hold Pro Author Sites harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Pro Author Sites, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Pro Author Sites against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Pro Author Sites's server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from Pro Author Sites's server.

DISCLAIMER 

Pro Author Sites will not be responsible for any damages your business may suffer. Pro Author Sites makes no warranties of any kind, expressed or implied for services we provide. Pro Author Sites does not guarantee to back up your data/Web site and whilst every attempt would be made in the unlikely event of any corruption or hardware failure, Pro Author Sites cannot guarantee to be able to replace lost data. Pro Author Sites disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all service interruptions caused by Pro Author Sites and its employees. Pro Author Sites reserves the right to revise its policies at any time.
